NIH Addendum for Publisher Agreements

Authors routinely sign publishing agreements that transfer copyright to the publisher, eliminating the author's ability to submit the article or manuscript as required by law. As an author, you need to make sure that you retain the rights to upload either the published version or the final manuscript version of your article to PubMed Central. The attached document is an example of how a publisher's agreement can be modified to enable you to remain compliant with the NIH Public Access Policy, found in the Public Access Frequently Asked Questions http://publicaccess.nih.gov/FAQ.htm#c3

Instructions for using the NIH Addendum:

1. Print out, sign and date the NIH Addendum. The corresponding author can sign on behalf of all authors. 

2. Staple the NIH addendum to the publisher’s agreement or copyright transfer form. 

3. Write “Subject to attached addendum” below your signature on the publisher’s copyright transfer or publication agreement form. This phrase along with your signature serves to inform the publisher that you accept the publisher’s agreement only if the publisher accepts the attached NIH addendum. 

4. Make copies of all the forms for your records.
